A devastating incident in Louisiana has led to criminal charges against a young mother after a tragic sequence of events in a gas station parking lot claimed the life of her 1-year-old son.

Elizabeth Aguilar, 22, was arrested in Baton Rouge weeks after the February incident that left her toddler, Nicholas Aguilar, fatally injured. According to police and reporting on the case, what initially appeared to be a tragic accident is now being treated as a matter of criminal negligence.

Investigators say the incident happened late in the morning near an Amazon fulfillment center, as Aguilar was driving a pickup truck through a gas station parking lot. While making a turn, the rear passenger door reportedly opened—allowing the unrestrained child to fall out of the vehicle.

Authorities say Nicholas then fell onto the pavement and was run over by the truck’s rear tire.

Emergency responders rushed the child to a nearby hospital, but he later died from his injuries.

As details emerged, investigators uncovered several concerning factors. According to police, the child was not secured in a car seat, and there were no child restraints inside the vehicle at all. At least one other child in the truck was also unrestrained at the time.

Officials noted that while the truck was equipped with child safety locks, they were not engaged.

Initially treated as a traffic incident, the case evolved as police continued their investigation. Ultimately, Aguilar was charged with negligent homicide, failure to use a child passenger restraint system, and additional vehicle-related violations, including lack of proper registration and insurance.

The tragedy has left a family grieving and searching for answers. A fundraiser organized by relatives describes the loss as “unimaginable,” with loved ones working to cover funeral expenses and support one another during an incredibly painful time.

The case also highlights a broader issue that safety advocates frequently emphasize: the importance of properly securing children in vehicles. Even brief drives or low-speed maneuvers can turn deadly when basic precautions are not followed.

For many, the incident is both heartbreaking and sobering—a reminder of how quickly ordinary moments can turn into irreversible tragedy.
